Injunction against Samsung Galaxy Tab 10.1 in Australia


 As in Germany, it seems Australia is not good for the Galaxy Tab 10.1 from Samsung. The Australian Federal Court has issued a preliminary injunction against the publication and sale of the Galaxy Tab 10.1. The injunction ensures that Samsung is crumbling, the Christmas season. Especially in the rapidly evolving world, the Tablet is a setback for Samsung.
 



Judge Annabelle Bennett ruled that the Samsung Tablet against two Apple patent violation, but Samsung will be offered the opportunity to appeal. Samsung itself was in this context that one would need time to an effective defense against Apple's lawsuit to prepare. Meanwhile, Samsung has announced to give up without a fight and not to appeal.

After Germany, Australia is the second country is prohibited in the Samsung Galaxy Tab 10.1 for now. The rulings could have an impact on other legal proceedings in South Korea and America.

The official statement from Samsung:

     We are disappointed with this ruling and Samsung wants to take all Necessary measures including legal action in order to Ensure our innovative products are available to consumers.

     This is a part of our ongoing legal proceeding against Apple's claim. Samsung is so confident it can prove Apple's violation of Samsung's wireless technology patents through a cross-claim filed on September 16, 2011 with the Federal Court of Australia, New South Wales.

     Our standard wireless patents are essential for mobile business. We will continue to legally assert our intellectual property rights against those who violate Samsung's patent and free ride on our technology.
